5 ATF officials singled out in GOP report

(AP) ? After an 18-month investigation into Operation Fast and Furious, a Republican congressional draft report concludes that five officials at the Bureau of Alcohol, Tobacco, Firearms and Explosives share much of the blame for what went wrong with the gun-smuggling probe in Arizona.

The first of what will be three reports says many people in the chain of command at ATF are responsible, but the investigation singled out five key figures in the controversy, ranging from the special agent in charge of the ATF's Phoenix field division up to the agency's director.

In Operation Fast and Furious, agents employed a controversial tactic called gun-walking ? allowing low-level "straw" buyers in gun-trafficking networks to proceed with loads of weapons that they purchased at gun shops in Arizona. The tactic was designed to track guns to major weapons traffickers and drug cartels, but many of the weapons weren't tracked and wound up at crime scenes in Mexico and the U.S., including the site of a shootout on the U.S. side of the border that resulted in the death of a border agent, Brian Terry.

"Suspects continued to acquire weapons under ATF surveillance at an alarming rate," said the report. "In the spring of 2010, concern was mounting among ATF leadership in Washington about the large volume of weapons being sold under Fast and Furious. The case became so large that ATF Deputy Director, William Hoover, requested an exit strategy for the case ? something he had never done before."

The operation nonetheless continued into the fall of 2010.

The former head of the ATF, Kenneth Melson, bears a significant measure of responsibility for failing to ensure that the agency's headquarters personnel adequately supervised the Phoenix field division, says the report compiled by staffers for Rep. Darrell Issa, R-Calif., and Sen. Chuck Grassley, R-Iowa. The report also says:

?Bill Newell, the special agent in charge in Phoenix for several years, was a major promoter of the strategy in Fast and Furious. The report said Newell failed to understand the basic legal standards needed for interdicting firearms and questioning potential suspects, a shortcoming that prevented interrogation, disruption and possible arrest of straw purchasers.

?Deputy Assistant Director William McMahon knew that no operational safeguards were in place to prevent the firearms from traveling to Mexico, yet made no effort to stop the flow of guns, believing that it was not his job to interfere in Newell's investigations.

?Assistant Director Mark Chait and his superior, Hoover, had several opportunities to put an end to the operation but failed to do so. Hoover knew that Newell had employed risky tactics in the past yet failed to monitor him closely.

Fast and Furious identified more than 2,000 weapons suspected of being illicitly purchased. Some 1,400 of them have yet to be recovered.

Apple, Samsung battle over iPhone and iPad patents

By Scott Martin, USA TODAY

Updated

SAN FRANCISCO ? Apple and Samsung will be duking it out in court this week about features that could be in your phone or tablet.

Apple alleges that its iPad and iPhone are being copied by Samsung and wants Samsung's products pulled from store shelves and online stores ? and to be awarded $2.5 billion in damages. Samsung disputes the claims and alleges Apple's iPhones run on its wireless technologies ? and that Samsung, in turn, should be paid royalties.

The high-stakes battle opens Monday in a federal court in San Jose in what will be one of the most widely watched Silicon Valley sagas.

"Obviously, Apple is going for injunctions on this," says Michael Barclay, a fellow with the Electronic Frontier Foundation. "There are a lot of things in the iPhone that were carefully thought out and easy to use."

The trial is scheduled to go before U.S. District Court Judge Lucy Koh, who last month awarded Apple a preliminary injunction that could force Samsung's Galaxy 10.1 from shelves pending the outcome of the trial.

The landmark legal case could have long-lasting ripple effects on more than 50 lawsuits waged worldwide between mobile phone makers powered by Google's Android mobile operating system and Apple, say legal experts.

"It's the most important trial between these players, so far," says independent analyst Florian Mueller. "Apple is hoping for a breakthrough that would have important implications for other lawsuits."

Consumers could notice some differences if companies are forced to dramatically alter their products or remove them from markets. Still, if Apple prevails, it wouldn't be long before mobile developers would create technology workarounds, say legal experts.

Apple is waging war about similarities in hardware design, software functions and packaging. To complicate matters, Samsung is a major partner and supplier of components to Apple.

Jurors will likely be familiar with many of the touch-screen gestures that will be on trial. Apple is lodging claims against Samsung about a patent that covers touch-based dragging of documents, as well as pinch-to-zoom and twist-to-rotate capabilities. Another patent from Apple on trial will be its tap-to-zoom function that makes text or images pop up larger. Apple is also claiming Samsung infringes on its scrolling patent.

"If Apple, over time, enforces enough touch-screen user-interface patents, it could have an effect (on) consumers," says Mueller. "Combined, they can make a real difference and have a significant effect on purchasing decisions by consumers."

Alternative Venture Finance: Federal Grants and Loans ...

While most firms seeking venture capital initially think of angel investors and venture capitalists, a sizable alternative source of financing is federal grants and loans. The two largest federal grant programs are run by the Little Company Administration (SBA), and by Modest Business Investment Organizations (SBICs).

An SBA loan, irrespective of regardless of whether it truly is a direct loan from the SBA, or, as is more typical, a bank loan assured by the SBA, is basically a bank loan. The advantage of it versus a traditional bank loan could be the rate. SBA rates are normally considerably less than standard organization loan rates.

In most situations, within a guaranteed SBA bank loan, the SBA guarantees 90 percent from the loan will probably be repaid towards the bank. As such, banks are at significantly less risk than in most other loans, and are a bit far more flexible with regards to who they offer these loans. Nevertheless, the SBA generally demands the founders from the firm to personally guarantee the loans, which makes them risky must the venture collapse.

Alternatively, Tiny Company Investment Businesses (SBICs) are privately organized corporations which can be licensed and regulated by the SBA. Little or emerging companies which qualify for help from the SBIC system can receive equity capital and/or long-term loans from these organizations. Essentially, these companies supply their very own capital, which can be supplemented by federal funds, towards the companies they fund.

Interestingly, U.S. taxpayers advantages from the SBIC program as tax revenues generated from effective SBIC investments have far more than covered the cost from the plan. Likewise the system has developed hundreds of thousands of jobs.

In summary, SBA and SBIC financing are viable alternatives to financing from angel investors and venture capitalists and really should be thought of inside the capital raising approach. Similarly to angel and VC financing, firms looking for SBA and SBIC financing want a strong management group and worth proposition, along with a highly specialist and compelling organization strategy so that you can raise the capital they need.

(AP Photo/Warner Bros. Pictures, Ron Phillips)

(AP) ? "The Dark Knight Rises" earned a sizeable $160.9 million over the weekend, making it the biggest 2-D opening ever, but falling slightly below expectations following the mass shooting at a Colorado screening of the Batman film.

Warner Bros. said Monday that the final installment of director Christopher Nolan's Batman trilogy earned $160,887,295.

The debut makes "The Dark Knight Rises" the biggest 2-D opening ever ahead of its 2008 predecessor, "The Dark Knight." It also gives the movie the third-largest opening after the 3-D films "The Avengers" with $207.4 million and "Harry Potter and the Deathly Hallows ? Part 2" with $169.2 million.

Despite the impressive $160.9 million opening, "The Dark Knight Rises" fell somewhat below box office expectations going into the weekend, which ranged from $170 million to $200 million.

"Clearly, 'The Dark Knight Rises' was on everyone's minds," said Paul Dergarabedian, an analyst for Hollywood.com who specializes in box office. "I think the American public showed they were not going to be sacred away from the movie theater by the actions of a lunatic."

Dergarabedian called the film's opening "extremely impressive given the tragic events that unfolded on Friday."

"Dark Knight Rises" earned $19.1 million alone from IMAX screenings. Tickets for 3-D and IMAX films cost a few more dollars than 2-D screenings, netting extra cash at the box office. Movies released in 3-D typically earn under half of their income in 3-D screenings, sometimes as little as a third.

Sony, Fox, Disney, Paramount, Universal and Lionsgate joined "Dark Knight Rises" distributor Warner Bros. in publicly withholding their usual revenue reports this weekend until Monday. They did so out of respect for the victims and their families after the mass shooting that left 12 dead and 58 wounded at a midnight screening of the movie in Aurora, Colo.

Following behind "Dark Knight Rises" in the No. 2 spot was "Ice Age: Continental Drift," the animated Fox film which dropped 56 percent in its second weekend to $20.4 million, and the Sony superhero reboot "The Amazing Spider-Man," which earned $10.9 million during its third weekend at the box office, in the No. 3 position.

The top 20 movies at U.S. and Canadian theaters Friday through Sunday, followed by distribution studio, gross, number of theater locations, average receipts per location, total gross and number of weeks in release, as compiled Monday by Hollywood.com are:

Paterno biography: Can it recover from bad timing?

Writer Joe Posnanski's biography on the late Penn State football coach comes after the infamous scandal involving Penn State coach Jerry Sandusky.

By Husna Haq / July 23, 2012

Publisher Simon & Schuster has drastically scaled back the book tour and other events for 'Paterno' by Joe Posnanski.

And with a rejiggered game plan chock full of author event cancellations, title tweaks, and frantic changes in the publication date, it?s also a lesson in damage control for the publishing industry.

?Paterno,? a forthcoming biography of the late Penn State football coach by author Joe Posnanski, has made Simon & Schuster ?the latest example of a publisher that is trying to recover when the story behind a planned book changes before publication,? reports The New York Times in a piece on the forthcoming bio?s bad timing.

And how the story has changed. ?Announced in March 2011 as ?a biography of America?s winningest college football coach, who changed the country one football player at a time,? the book will enter the marketplace at a moment when the name of Joe Paterno, the late Penn State coach, has gone from revered to radioactive,? writes the Times.

In the wake of the Penn State scandal, Paterno, who died of lung cancer in January at the age of 85 after 46 years as head coach at Penn State, has fallen hard. Following accusations of child sexual abuse by Paterno?s longtime assistant coach, Jerry Sandusky, reports emerged suggesting Paterno was aware of the abuse accusations and failed to report it. One in particular, a July 12 report by Louis J. Freeh, a former director of the FBI, that found Paterno not only failed to report accusations of abuse to police, but also renegotiated his contract in 2011 as the scandal was unfolding, ?winning himself and his family more money and perks,? was particularly damaging to the late coach.?

Since then, Paterno?s alma mater, Brown University, axed his name from a prestigious annual award and coaching position. And Penn State President Rodney Erickson ordered the removal of a statue of the late coach from outside the university?s football stadium, commenting in a statement, ?I believe that, were it to remain, the statue would be a recurring wound to the multitude of individuals across the nation and beyond who have been victims of child abuse.?

The turn in public perception of the once-beloved JoePa has ?made people angrier at Joe Paterno,? Simon & Schuster publisher Jonathan Karp told The New York Times. ?And that has made it a more difficult environment to publish a biography about Joe Paterno.?

Among the publishers' damage control measures: the release date was changed from Father?s Day 2013 to August 2012 and the title changed from a majestic ?The Grand Experiment: The Life and Meaning of Joe Paterno,? to a more modest ?Paterno.?

What?s more, Posnanski?s book tour has been scaled back and scores of author interviews, book signings, and events have been cancelled. ?We?re sensitive about putting our author in forums where he might be viewed as a stand-in for his subject,? Simon & Schuster spokeswoman Anne Tate told the Times.

Already, Sports Illustrated declined to run an excerpt in its pages and some bookstores have said they will not carry the book.

It?s a vexing challenge for any publisher certain it had a touchdown on its hands only to find itself scrambling to stay in the game. For his part, S&S publisher Karp is shifting the focus away from the once-celebrated coach to his biographer.

As he told the Times, ?People can pass all the judgment they want about Joe Paterno, but Joe Posnanski deserves a chance to be read.?

Big 12 coach of year will get Neinas trophy

DALLAS (AP) ? The Big 12 is honoring Chuck Neinas by naming their football coach of the year award after the interim commissioner credited with being such a stabilizing force during his nearly yearlong tenure.

New Big 12 commissioner Bob Bowlsby surprised Neinas with the announcement Monday during the opening minutes of the league's football media days.

"During a time when there was great instability, we were fortunate enough to entice Chuck Neinas to come and put his hand on the tiller and try and bring a period of calm to the league," Bowlsby said. "Under his guidance, we brought TCU and West Virginia into the league. He had a tremendous calming force. And through his sage advice and insights and experience, we were able to get through a really tough time."

Neinas said it was an honor he will cherish and that he had great support during his time with the Big 12.

"As I've often said, if the Big 12 is a stock, you get a buy order from me," said Neinas, who is wrapping up his time with the league as a consultant for a few more weeks.

CYCLONE CLEARED: Iowa State running back Shontrelle Johnson, who injured his neck in the fourth game last season, has been cleared to play.

Coach Paul Rhoads said Johnson can be on the field when the Cyclones start practice Aug. 3. That gives Iowa State its top five rushers back from last season.

Johnson ran for 247 yards and averaged 4.8 yards per carry before getting hurt. There had been uncertainty about whether he would be ready for the start of his junior season ? if at all.

"There were doubts until he went through a set of X-rays this summer that had to be looked at by his surgeon and the fusion that took place that was fully healed, fully fused, and that he gave his blessing that he could play," Rhoads said. "From there, Shontrelle and his family, specifically his mother, had to sit down and make the decision that they were going to resume playing college football."

Johnson is behind James White and Jeff Woody on the depth chart.

"Certainly he'll have to work his way back up the depth chart. He's been out for a while. But we look forward to him doing that," Rhoads said. "My biggest concern as he begins that process, is he does it with his head up and fundamentally does all the things to protect himself as he moves forward."

___

GETTING DEFENSIVE: After a 41-38 win at then-undefeated Oklahoma last season, Texas Tech was 5-2.

But the Red Raiders didn't win again and finished with their first losing record since 1992.

"The big game we won last year against Oklahoma, we played over our heads. We were able to knock some plays down. We played well on third down. A lot of young guys. A lot of guys that learned a lot from that game," coach Tommy Tuberville said. "We weren't able to duplicate that defensive effort the rest of the year the next five games."

Twice after that, the Red Raiders gave up 66 points. Only one of the last five opponents scored less than 41 points.

But Tuberville is feeling better with new defensive coordinator Art Kaufman, who has coached with him, and some building depth on defense.

"We've got more depth. We've got more talent. We've doubled our talent, so to speak, in the last couple of years on defense," Tuberville said. "We're going to be fine offensively. We need to have a little bit of luck keeping guys healthy."

___

MARRIED SIGNAL-CALLERS: A pair of Big 12 quarterbacks got married this summer.

Kansas State quarterback Collin Klein, whose 27 rushing touchdowns last season broke the Big 12 record and matched the most for a BCS quarterback, married the daughter of former Kansas State standout and Kansas City Chiefs Hall of Famer Gary Spani.

Oklahoma's Landry Jones got married earlier this month to former Lady Sooners basketball player Whitney Hand.

"Good for him. He's got a special wife, too," Oklahoma coach Bob Stoops said. "Now we'll coach Landry like we always have."

Kadokawa Games, Grasshopper Manufacture's publishing partner in Japan,?has announced that the ever so divisive Lollipop Chainsaw has reached the 100,000 mark in terms of domestic shipments. Suda 51's game never tend to do very well, so this is exciting news even if you think the game is offensive for reasons.?

In honor of that achievement Kadoakawa will be hosting an event called the "Lollipop Chainsaw Summer Appreciation Festival." Taking place at the publisher's Tokyo offices, Kadokawa is?inviting?200 members of the general public to participate in the festivities and rub elbows with the likes of Goichi Suda and Jessica Nigri.

If you understand the moonspeak, are over 18 and would like to attend you can head over to their official site to participate in the lottery. Should you not meet those requirements, might I suggest following my lead and attacking the game a second time around for a higher score. Stanislaus County exhibit at the California State Fair

The Stanislaus County exhibit display at the California State Fair in Sacramento is pretty cool. I had a chance to see it at the Fair's opening day. I really liked how it showcased products that come from the area.

If you plan to make it out to the fair, check out Exhibit Building A on the bottom floor to see all of the county displays. You can tell everyone involved put a lot of effort into representing the charm of each individual county.

Cyber Attacks No Longer a Big Biz Problem ... - Small Business Trends

Join me, along with other small business owners and managers, for a discussion about how small businesses are now being?deliberately?targeted by cybercriminals ? and what you can do to protect your business.

In the first 6 months of 2012, the number of targeted attacks against small businesses, has doubled. ?And when your organization is smaller, your budget and your IT defenses tend to be smaller. ?So it can be a business-survival issue for a small business.

Thanks to Symantec, we?re bringing together security experts on Thursday, July 19 at 4pm New York time (1pm Los Angeles time) to discuss what you need to be aware of and what you can do to protect your business. ?We?ll cover the following:

  • What is a targeted attack and how it differs from other cyber threats
  • Why small businesses are being targeted (so you know what criminals are after!)

Questionnaire completed by parents may help identify one-year-olds at risk for autism

ScienceDaily (July 13, 2012) ? A new study by University of North Carolina School of Medicine researchers found that 31 percent of children identified as at risk for autism spectrum disorders (ASD) at 12 months received a confirmed diagnosis of ASD by age 3 years.

In addition, 85 percent of the children found to be at risk for ASD based on results from the First Year Inventory (FYI), a 63-item questionnaire filled out by their parents, had some other developmental disability or concern by age three, said Grace Baranek, PhD, senior author of the study and an autism researcher with the Program for Early Autism, Research, Leadership and Service (PEARLS) in the Department of Allied Health Sciences at the UNC School of Medicine.

"These results indicate that an overwhelming majority of children who screen positive on the FYI indeed experience some delay in development by age three that may warrant early intervention," she said.

Lead author of the study, Lauren Turner-Brown, PhD, also a researcher with PEARLS and the Carolina Institute for Developmental Disabilities said, "Identification of children at risk for ASD at 12 months could provide a substantial number of children and their families with access to intervention services months or years before they would otherwise receive a traditional diagnosis."

The First Year Inventory was developed by Grace Baranek, PhD, Linda Watson, EdD, Elizabeth Crais, PhD and J. Steven Reznick, PhD, who are all researchers with PEARLS. All are also co-authors of the study with Turner-Brown, published online ahead of print on July 10, 2012 by Autism: The International Journal of Research & Practice.

In the study, parents of 699 children who had completed the FYI when their child was 12 months old completed additional screening questionnaires when their child reached age 3. In addition, children who were found to be at risk for ASD based on these measures were invited for in-person diagnostic evaluations.

"These findings are encouraging and suggest promise in the approach of using parent report of infant behaviors as a tool for identifying 12-month-olds who are at risk for an eventual diagnosis of ASD," Turner-Brown said.

Headline Writing And What To Do To Write Them Well | Local ...

Most people do not have any idea about what is feasible with headline writing, and we really are speaking about the range of effects.

There are basically two components to headline writing you need to possess. Writing fantastic headlines is a learned skill, you just need to find good information to figure out how to do it. The other thing you?ve got to master is the ability to keep working as hard as you can to get as good as possible.

That?s really all there is to it but there are a few supporting tasks that you need to do, like understanding who you are addressing. Every headline you compose is going to be written to a particular market?it?s an integral part of your equation for success. It?s a fair guess that the rules are different for each type of headline writing (for press releases as opposed to writing an article) and you need to figure out what the rules are for all of them.

Writing headlines is very important. Press release headlines fall into this category as well. Capturing the audience?s attention is something you should do, specifically using your primary keyword or phrase. Including the name of the person or business in the release is absolutely necessary. This can get a little cumbersome if the press release is about multiple people or businesses. You have no problems with this if you use this one approach: simply add the most prominent name in the headline itself. Every headline that you do needs to mention this so that people will take notice of your press release.

If you write headlines, using Why, Ways To or Strategies To, and How To at the beginning is one of the best ways to make a great short headline. The features and benefits of your product should be known and presented. So whatever you are selling, but the benefit in the headline and you?re done. Any benefit that is chosen needs to move people, motivating them to click to see what you have. If you want more punch, then combine this approach with using numbered lists in the headline.

I do hope what you will have reading through to this point with reference to info for headline writing, as well as additionally the information to do with web marketing, is helpful to you personally. Please continue reading a bit more to get added insights about these topics.

Your press release headlines and similar audiences require you to write headlines in the third person. The goal is to get the releases to be read by people who are not already in your audience. Media people tend to read your press releases to see if anything in them is useful. If they find it, you?ll be written about and reported on. Your headlines have to adopt neutral tones and be completely in the third person. This is not at all hard, even though it might sound like it is; the fact is that if you can do it the right way once, you will be able to do it the right way every time. In conclusion, writing headlines as a skill you can develop if you utilize enough effort. You can actually get much better by practicing every single day. Your headlines can be very short, but extremely definitive. This makes them easy to write, though they are not. Smart writers will always learn how to do this, taking it very seriously.

Nutrient Drink Might Boost Memory in Early Alzheimer's: Study

MONDAY, July 9 (HealthDay News) -- A daily drink combining several nutrients appears to help people with early Alzheimer's disease improve their memory, a new study suggests.

As Alzheimer's progresses, patients lose their memory as synapses (connections between brain cells) deteriorate, according to background information included in the study. The new drink, called Souvenaid, may actually stimulate the growth of new synapses, said the drink's inventor, Massachusetts Institute of Technology scientist Dr. Richard Wurtman.

But more research is needed before the drink could be made available to the public. And, even then, consumers should exercise caution, said William Thies, vice president for medical and scientific affairs at the Alzheimer's Association.

Nutricia, a division of Dannon, sponsored the study. MIT has a patent on Souvenaid, and Nutricia has the exclusive license on the patent.

"Existing data now suggests that it may be possible to receive something that will sustain cognition in people with Alzheimer's disease with a limited concern about side effects," Wurtman said.

Previous experiments in animals showed that giving them the three compounds included in the drink increased the production of synapses improving brain function, he said.

For the new study, nearly 260 early Alzheimer's patients in Europe drank either Souvenaid or a placebo for six months.

During the first three months of the study, patients in both groups showed improved memory. After that, however, patients taking the placebo had a decline in memory. In contrast, patients taking Souvenaid continued to show improved memory on tests used to assess Alzheimer's patients.

Whether Souvenaid will slow the progression of Alzheimer's isn't known. There is, however, a longer trial going on that might answer that question, Wurtman said. "I don't think it has any effect on the fundamental diseases process, but we'll see," he said.

The report was published in the July 10 online edition of the Journal of Alzheimer's Disease.

The drink combines three ingredients: choline, uridine and omega-3 fatty acids.

Choline is a B vitamin found in meats, nuts and eggs, and omega-3 fatty acids are found in fish, eggs, flaxseed and meat from grass-fed animals. Uridine, which is produced by the liver and kidneys, is also found in some foods as a part of RNA, which helps make protein in the body.

These nutrients, along with other proteins, are essential for making brain-cell membranes that form synapses. To be effective, all three compounds must be given together, the researchers said.

Nearly all patients drank the nutrient cocktail consistently throughout the study, and there were no serious side effects, the researchers reported.

To show the drink's effect on the brain, patients underwent electroencephalography (EEG) throughout the trial. During the study, the brains of those taking the drink shifted from patterns of dementia to more normal ones, the researchers found.

Since EEG patterns reflect the activity of synapses, this result suggests that synaptic function increased with treatment, the researchers said.

An earlier study found that patients with more advanced Alzheimer's did not benefit from Souvenaid, most likely because brains cells had already been lost so new synapses couldn't develop, Wurtman said.

There are as yet no plans to market Souvenaid, so the cost hasn't been established, company spokesman William Green said.

"Souvenaid is a test product in development, which is still undergoing clinical trials," Green said. "No plans for the introduction of Souvenaid to the market -- either in Europe or the U.S. -- have been confirmed. It is probable that any introduction would take place first in Europe."

An ongoing study will evaluate the product over two years. If it appears to have a positive effect, then it may be something that could benefit patients even before definitive symptoms of Alzheimer's appear, Wurtman said.

Thies, of the Alzheimer's Association, is very cautious about the benefits of Souvenaid.

"Medical foods do not have a requirement for FDA premarket approval, but they do have a requirement for having a scientific foundation and some evidence of efficacy," he said. "But they don't have the kind of data we would find for a medication."

That makes it difficult to make a clear-cut statement about the value of the product, he said.

"There isn't a clear diet that prevents you from getting Alzheimer's disease or improves your memory," Thies said.

In addition, medical foods for Alzheimer's most likely won't be covered by insurance, he said.

"You are making a judgment without the protections you have when dealing with a medication," Thies said. "You're going to be making a decision using your own funds and we would advise anybody to make sure they understand what the product offers and make sure they understand what it's going to cost."

Law Enforcement Feasts on Cellphone Data | Inside Google

The application of constitutional protections in the digital world is far from clear, in many cases, but law enforcement agencies aren?t waiting for permission to access data ? they?re bombarding providers with requests for information. ?It is an outrageous intrusion on users? privacy and potentially troublesome in terms of our eroding constitutional rights,? said Consumer Watchdog?s John M. Simpson.

A congressional inquiry conducted at the behest of Rep. Edward Markey, D-Mass., found that law enforcement agencies made 1.3 million requests to cellphone carriers in 2011 for such information as individuals? text messages, their locations, and even lists of phone numbers they called when in the vicinity of a particular tower, whether they belonged to people under investigation or not. Wiretaps figured prominently in the mix of requests.

The report highlights the growing frequency of law enforcement agencies? reliance on cellphone carriers in their investigations. Requests to Verizon, for example, rose 15 percent year over year in 2011.

It is little wonder, given the wealth of information that can be gleaned about a suspect from his or her phone, Mary Ann Wymore, an attorney Greensfelder, Hemker & Gale, told TechNewsWorld.

?Cellphones are a font of easily accessible information about someone,? she said. ?Most cellphones sold within the last 18 months or so have what?s known as E911 technology, making the phones essentially tracking devices.?

?Eroding Constitutional Rights?

The report confirmed privacy advocates? worst suspicions.

?It is an outrageous intrusion on users? privacy and potentially troublesome in terms of our eroding constitutional rights,? John M. Simpson, Consumer Watchdog?s privacy project director told TechNewsWorld.

Consumers get uneasy when they hear such statistics because they know there are no checks and balances governing these requests, Steve Durbin, global vice president of the Information Security Forum, told TechNewsWorld.

The fundamental question, he said, is why does the information need to be accessed?

Plausible answers could include state security or other national interests.

?I think most people would not disagree with either of these,? he said. ?But how do you know that these are the real reasons? Can you be certain? What recourse does the citizen have when things go wrong and privacy is violated in error??

Constitutional Haze

Law enforcement officers are quite aware of the amount of information that carriers are collecting about consumers, Simpson said, and that?s? one factor driving the proliferation of requests.

The laws governing the release of cellphone consumer data and other digital information to government entities are murky ? something that? officials also know and push to their greatest advantage, he added.

?In so many areas, it is unclear where our constitutional protections begin and end,? observed Simpson ? areas like email, cloud computing and cellular communications.

Technology Outpaces the Law

In the case of cellphones, there is no comprehensive federal law that addresses questions of who or for what purpose cellphone data can be? accessed, according to Wymore.

?There is much debate as to the appropriate analytical framework for resolving these issues. On the one hand, there is precedent for the argument there is an expectation of privacy in such data. But others argue that tracking information is essentially ?public? information and therefore there is no expectation of privacy.?

The monitoring of electronic communications is not a new phenomenon, noted Roger Goff, a partner at WRSS&R.

The Communications Assistance for Law Enforcement Act, passed in 1994, established standards for electronics manufacturers and service? providers to allow law enforcement to gather information from electronic communication devices, he told TechNewsWorld.

?This law expanded to include virtually all Internet traffic,? said Goff. ?This was apparently viewed as reasonably necessary as a means of giving law enforcement the power to investigate and stop criminal activity.?

The recent increases in requests to cellphone carriers reflect the changes in communication habits rather than any shift in policy or political climate, in his view.

?Cellphones have become the primary communication device for a vast number of citizens and residents ? probably the majority,? noted Goff. ?They use it not only for voice communication, but for texting, emailing, and posting to social media. All of these transactions are not only recorded, but each recording is stamped with the time and the place from which it was made. That is a treasure trove of information for law enforcement. As the public?s reliance on mobile communication increases, it makes sense that law enforcement?s desire to access that information would also increase. ?

That doesn?t mean law enforcement should have unfettered access to all cellphone information, he continued.

?However, the requests to cellphone carriers are generally made either pursuant to a warrant or a subpoena. This means that in the majority of cases, either a court has already approved the action, or the consumer has a means of challenging the action in front of a judge,? Goff explained. ?Those mechanisms are supposed to provide protection against law enforcement abuse.?

Does it always work? ?Of course not,? he said. ?But is it patently unlawful? Not at all.?

Baseball cards in Ohio attic might fetch millions

DEFIANCE, Ohio (AP) ? Karl Kissner picked up a soot-covered cardboard box that had been under a wooden dollhouse in his grandfather's attic. Taking a look inside, he saw hundreds of baseball cards bundled with twine. They were smaller than the ones he was used to seeing.

But some of the names were familiar: Hall of Famers Ty Cobb, Cy Young and Honus Wagner.

Then he put the box on a dresser and went back to digging through the attic.

It wasn't until two weeks later that he learned that his family had come across what experts say is one of the biggest, most exciting finds in the history of sports card collecting, a discovery worth perhaps millions.

The cards are from an extremely rare series issued around 1910. Up to now, the few known to exist were in so-so condition at best, with faded images and worn edges. But the ones from the attic in the town of Defiance are nearly pristine, untouched for more than a century. The colors are vibrant, the borders crisp and white.

"It's like finding the Mona Lisa in the attic," Kissner said.

Sports card experts who authenticated the find say they may never again see something this impressive.

"Every future find will ultimately be compared to this," said Joe Orlando, president of Professional Sports Authenticator.

The best of the bunch ? 37 cards ? are expected to bring a total of $500,000 when they are sold at auction in August during the National Sports Collectors Convention in Baltimore. There are about 700 cards in all that could be worth up to $3 million, experts say. They include such legends as Christy Mathewson and Connie Mack.

Kissner and his family say the cards belonged to their grandfather, Carl Hench, who died in the 1940s. Hench ran a meat market in Defiance, and the family suspects he got them as a promotional item from a candy company that distributed them with caramels. They think he gave some away and kept others.

"We guess he stuck them in the attic and forgot about them," Kissner said. "They remained there frozen in time."

After Hench and his wife died, two of his daughters lived in the house. Jean Hench kept the house until she died last October, leaving everything inside to her 20 nieces and nephews. Kissner, 51, is the youngest and was put in charge of the estate. His aunt was a pack rat, and the house was filled with three generations of stuff.

They found calendars from the meat market, turn-of-the-century dresses, a steamer trunk from Germany and a dresser with Grandma's clothes neatly folded in the drawers.

Months went by before they even got to the attic. On Feb. 29, Kissner's cousin Karla Hench pulled out the dirty green box with metal clips at the corners and lifted the lid.

Not knowing whether the cards were valuable, the two cousins put the box aside. But Kissner decided to do a little research. The cards were at his office in the restaurant he owns when he realized they might have something. He immediately took them across the street and put them in a bank vault.

Still not knowing whether the cards were real, they sent eight to expert Peter Calderon at Heritage Auctions in Dallas, which recently sold the baseball that rolled through the legs of Boston Red Sox first baseman Bill Buckner in the 1986 World Series for $418,000.

Calderon said his first words were "Oh, my God."

"I was in complete awe," he said. "You just don't see them this nice."

The cards are from what is known as the E98 series. It is not clear who manufactured them or how many were produced, but the series consists of 30 players, half of them Hall of Famers.

The experts at Heritage Auctions checked out the family's background, the age of the home and the history of the meat market. They looked at the cards and how they were printed.

"Everything lines up," said Chris Ivy, the company's director of sports auctions.

They then sent all the cards to Professional Sports Authenticator, which had previously authenticated fewer than 700 E98s. The Ohio cards were the finest examples from the E98 series the company had ever seen.

The company grades cards on a 1-to-10 scale based of their condition. Up to now, the highest grade it had ever given a Ty Cobb card from the E98 series was a 7. Sixteen Cobbs found in the Ohio attic were graded a 9 ? almost perfect. A Honus Wagner was judged a 10, a first for the series.

Retired vintage sports card auctioneer Barry Sloate of New York City said: "This is probably the most interesting find I've heard of."

In a measure of what baseball cards can be worth, the owner of the Arizona Diamondbacks paid a record $2.8 million for a rare 1909 Honus Wagner. Another version of the card brought $1.2 million in April.

Heritage Auctions plans to sell most of the cards over the next two of three years through auctions and private sales so that it doesn't flood the market. In all, they could bring $2 million or $3 million, Ivy said.

The Hench family is evenly dividing the cards and the money among the 20 cousins named in their aunt's will. All but a few have decided to sell their share.

"These cards need to be with those people who appreciate and enjoy them," Kissner said.

A blogger's Journey from 1st post to the 100th? | Being Arindam..

Time to celebrate and thank you all?..

All the journey we cover in our lifetimes are not beautiful. But I started a journey on 22nd September 2011, which was beautiful. A journey which helped me to meet some really wonderful and talented people, a journey which helped me to grow as a person, a journey which made me realize that, it?s not good to stereotype people according to their nationality, religion or gender.

Yes I am talking about my journey in blogging world. On?September 22nd, I gave birth to my blog (yes blogospehere is the only place, where a male can also give birth to a new life) with a post dedicated to my mother.??For first like every one else, I did not have much readers. I still remember the excitement, the joy and?happiness of seeing a single like or comment on my posts. It was a different feeling to realize that, someone from a different corner of this world, like your thoughts. I still remember the happiness on my face- when Renee left those beautiful and inspiring words in my blog?s comment section. I still remember Melissa?s attempts to help me realize that, I am a writer. I still remember Darla and Lenore leaving those friendly and kind words for me; so that I could keep on writing without much caring about readers. I still remember Becky passing on a award to my blog to pass on some real inspiration. I still remember the first comment I got from Sir Charles on my comment box- whom I consider a true inspiration. Then slowly slowly the list started to grow. I love and respect each of you wonderful people whom I met through blogging. Now If I would mention each one of you, in order to say thank you; then the list would be a really long one. So when I am saying, ?A big Thank You?; then believe me it was from bottom of my heart just for you.

When I first started writing, grammatical?errors were the most integral part of my writing. But none of you ever complained about that; rather you people help me realize my own mistakes and let me to rectify them by my own. To be honest I do not feel ashamed about those mistakes, because as an intelligent person once said, ?We do not need to feel ashamed?committing?a mistake while we are writing or speaking English as no one is perfect in foreign language?. So it ?was a?continuous?process for me and the process still continues- to learn this art of writing and to grow as a writer with time. As a computer engineer- ?Grammars?hardly matters to us, but what matters to us is the Syntax.? But now I do realize the importance of grammar?in writing. During my early days of blogging, I had a habit of writing ?i? in stead of ?I?, in the middle of a sentence when I had to refer myself. It was the real example of how things like SMS and status messages are polluting the English language. And one fine day- someone mentioned it to me in her comment on one of my posts and thanks to her, now I occasionally commit that mistake while I write. These are the small things, which help me to learn the process of writing. So thanks to all of you intelligent people, now I do realize that- one day I can be a writer.

During early days of blogging?.. A day when I had no visitors to my blog!

Not many of my friends or family members have idea, that I have a blog. To be honest many have also no idea ?What is this blogging all about??. When my blog started getting some what little recognition, I tried to tell few of my dear people that, ?Hey now I have a blog?. But the first question they asked was- ?how much money are you earning from that?? By getting such a reply, I just smiled and realized why people say ?in today?s world money is the one and only thing that matters?. Then I never bothered to tell someone about my blog again. So for first there were days, when I have no users visiting my blog, no likes or comments to inspire me to write again. But slowly slowly I started?receiving?inspiration and motivation in form of your comments, which helped me to keep on writing.

The longest wait ?? to welcome the 1000th visitor

The excitement of seeing my blog getting its 1000th visitor was something really special, which I can?t describe with words. May be I am not that good as a writer yet to express those moments with words. And let me tell you the journey from 999th visitors to 1000th visitors was a really long one.

It?s a fact that?..When God give, he give in large numbers!

Then after few months I reached the 10000th and few days earlier the 25k mark. Now my child is mature enough to take care of herself; so I am no more worried about her. I always wanted my child to grow by her own. So I never hit my blog URL without loging in, so that I could help the stat of my blog to change with my click. I am glad she could grow by her own.

A proud moment for a blogger- To see the number of visitors in five digit.

More than anything else I am somehow feel proud of myself that- I could able to write more than 60000 words in past 9months of blogging. Although I do realize that among those words; some were meaningful and some were meaningless. :)

I do believe that, there are two sides of a coin; so if a person loves money; then he has to accept and love two sides of the coin. So after blogging I started realizing if I am involve in any creative process then I have to accept both the positive words and negative words of my reader? until and unless they are not hurting. For me two sides of the coin(writing) which I love are my supporters and my critics; and honestly I love and respect both these groups of people. One group wants and inspires me to grow while helps and challenges me to grow.

Thank you for making me part of your search?.. Some interesting Search terms people used to reach my blog!

Sometimes the search term with which people enter my blog make me laugh out really loud and also sometimes astonish me. Sometimes when someone wants me to give her love song, it makes me feel special and when some one wants me to marry her in next birth, I just want to reply her with? ?Sweet heart, I am still alive and single. So your wish can be fulfilled? in this birth too?. When someone mention me ?RomeoVedio? it makes me laugh and when someone ask in his search term ?How Arindam got success in his life? it makes me realize that, there is someone who want me to see successful but for now truth is something else and when someone types ?Arvindam? instead of ?Arindam?or reaches my blog with search term like? ?broken lover boy? it makes me angry. :)

Still these are the moment I do cherish and love. So thank you for supporting me, thanks for loving me, thanks for accepting me the way I am and not to forget thanks for inspiring me and motivating me not only to be good writer but also to be a good human being.

I know your support is unconditional. And I really do hope and wish that, you are going to keep on supporting me in this journey. I can?t give anything in return to the time you spend in ?being Arindam?. I can only wish all the happiness, peace and success for you all wonderful people?.

I know as soon as you will finish reading this long post, you will type- ?C??. then ?O??. then ?N??. then ?G??.. then ?R?? and two other alphabets. So a big thank you once again in advance to you all. :)
