Apple iPad sales disappoint, Street eyes the holidays

SAN FRANCISCO (Reuters) - Apple Inc delivered a second straight quarter of disappointing results and iPad sales fell well short of Wall Street's targets, marring its record of consistently blowing past investors' expectations.

Shares in the world's most valuable technology company briefly dipped to levels not seen since the start of August, after it delivered a 27 percent rise in fourth-quarter revenue and a 24 percent increase in earnings.

The numbers, while in line with expectations, lacked the positive surprises that investors have grown used to, and came after Apple undershot revenue targets in the previous quarter. Its shares bounced back after CEO Tim Cook told analysts on a conference call that the latest iPhone 5 was heavily backlogged but the company had mostly worked out kinks in its supply chain.

Apple shipped 26.9 million iPhones in the last quarter, just ahead of analysts' predictions, but iPad sales of 14 million were well below lowered forecasts for the tablet as the economy remained weak and consumers awaited the iPad mini, which will hit store shelves next month. South Korean rival Samsung Electronics Co sold 56.3 million smartphones in the quarter, according to research firm IDC, giving it 31.3 percent global market share, more than double that of Apple.

FEVERED COMPETITION

Analysts say the real test for Apple will come during the crucial year-end holiday shopping season, when competition will reach fever-pitch against new gadgets from Amazon.com Inc, Google Inc and Microsoft Corp.

"Going into earnings we were wondering if the slowing economy will catch up with Wall Street, and it has," said Channing Smith, co-manager of the Capital Advisors Growth Fund.

"Apple is very well positioned with the iPad and now the iPad mini. It has a great smartphone and we expect the iPhone 5 to sell very well. The outlook is conservative, but that's not surprising. Err on the side of caution is a proven formula."

Apple heads into the current quarter after refreshing almost all of its product lines, including introducing an upgraded, fourth-generation full-sized iPad. The December quarter will show how well consumers respond to its latest gamble - the iPad mini - which goes on sale on November 2.

Quarterly revenue in China, Apple's second-largest market, rose 26 percent, and jumped nearly 80 percent to $23.8 billion (14.7 billion pounds) over the full year, contributing 15 percent of Apple's total, Cook told analysts. Apple plans to launch the iPhone 5 in China in December, hoping to staunch market share loss in what is set to become the world's largest smartphone market this year.

Apple's China smartphone market share almost halved to 10 percent in April-June as buyers waited for the iPhone 5.

ONE WEEK LESS

For the December quarter, Apple forecast revenue of $52 billion, below the average estimate of $55 billion, according to Thomson Reuters I/B/E/S. It expects margins of 36 percent, far lower than analysts' expected 43 percent.

Chief Financial Officer Peter Oppenheimer mostly attributed the lower margin and conservative guidance to a combination of a stronger dollar, higher costs associated with new products, and the fact that Apple's next fiscal quarter has one less week than the same period a year ago.

Apple's stock was holding steady at $609.40 in extended trade after flirting with the $600 level. The shares had ended regular trade at $609.54.

Supply constraints holding up sales of the iPad and iPhone dominated discussions between analysts and Apple executives during the post-results conference call. Apple had struggled to deliver large quantities of the iPhone 5 since its launch in late September, with the waitlist for the device at one point stretching to three weeks in some regions.

"Our supply output is significantly higher than it was earlier in October," Cook said, referring to the iPhone 5. "And I'm confident we'll be able to supply quite a few during the quarter."

CAR THAT FLIES AND FLOATS

Cook also opined on Microsoft's new Windows 8-based Surface tablet that will hit stores early on Friday.

"I haven't personally played with the Surface yet, but what we're reading about it, is that it's a fairly compromised, confusing product," he said. "I suppose you could design a car that flies and floats, but I don't think it would do all of those things very well."

Despite the lacklustre fourth quarter, Apple put up big numbers for the year, ending its fiscal 2012 with a 45 percent increase in revenue to $156.5 billion, while net income was up 61 percent at $41.7 billion.

For the final fiscal quarter, it posted net income of $8.2 billion, or $8.67 a diluted share, on revenue of $35.96 billion, versus $6.6 billion, or $7.05 a share, a year earlier. Analysts had expected on average that Apple would earn $8.75 per share.

Apple ended the quarter with $121.3 billion in cash and securities, of which $83 billion was offshore.

56 dead in renewed ethnic violence in west Myanmar

KYAUKTAW, Myanmar (AP) ? At least 56 people have been killed and 1,900 homes destroyed in renewed ethnic violence in western Myanmar as the government warned perpetrators and the international community appealed for calm.

About 75,000 people remain in refugee camps since an outbreak of violence in June between the Buddhist Rakhine and Muslim Rohingya communities in which at least 90 people were killed and more than 3,000 homes were destroyed. Curfews in place in some areas since then have been expanded with the latest violence, but tensions have stayed high in part because the government has failed to find any long-term solution other than segregating the communities, which have long been in conflict.

Since Sunday, 25 men and 31 women were reported dead in four Rakhine state townships, local government spokesman Win Myaing said. Some 1,900 homes had been burned down in the fresh conflict, while 60 men and four women were injured. It was unclear how many of the victims were Rohingya people and how many were Rakhine.

The United States called for Myanmar authorities to take immediate action to halt the violence. The United Nations appealed for calm.

Myanmar's state daily Myanma Ahlin reported Friday the President's office has warned it will take action against instigators involving in the clashes.

"As the international community is closely watching Myanmar's democratic transition, such unrest could tarnish the image of the country," said the announcement.

An Associated Press photographer who traveled to Kyauktaw, one of the affected townships 45 kilometers (75 miles) north of the Rakhine capital of Sittwe, said he saw 11 wounded people brought by ambulance to the local 25-bed hospital, most with gunshot wounds.

One was declared dead after arrival. All the victims being treated were Rakhine, but that could reflect an inability or unwillingness of Rohingya victims to be treated there.

A volunteer at the hospital, Min Oo, said by telephone that five bodies, including one of a woman, had also been brought there. He said the injured persons were brought by boat from Kyauktaw town 16 kilometers (10 miles) away, and taken from the jetty by the ambulances.

An account by a Rakhine villager in the area suggested great confusion and tension. The villager said that when groups of Rakhine and the Rohingya had a confrontation, government soldiers shot into a crowd of Rakhine, even though, according to his claim, it had been dispersing. The villager would not give his name for fear of violent reprisals.

There have been concerns in the past that soldiers were failing to protect the Rohingya community, but the Rakhine villager's account hints that Myanmar's military may have been defending the Rohingya in this case.

"We feel very unsafe because soldiers are not protecting us but protecting the Muslim villages. They shot the Rakhine people when people got near Muslim villages," said Aung Than, a resident of Kyauktaw township, 74 kilometers (46 miles) north of Sittwe. "Soldiers did not shoot in the air, but they shot at the Rakhine people."

The United Nations called for calm and for it to be given access to the area for humanitarian purposes.

"The U.N. is gravely concerned about reports of a resurgence of inter-communal conflict in several areas in Rakhine State ? which has resulted in deaths and has forced thousands of people, including women and children, to flee their homes," U.N. Resident and Humanitarian Coordinator in Myanmar Ashok Nigam said in a statement.

Large numbers of people fleeing the new violence were headed for already overcrowded refugee camps, the U.N. official said, advocating short-term humanitarian support and action toward long-term solutions.

In Washington, State Department spokeswoman Victoria Nuland said the U.S. was deeply concerned about the reports and urged restraint.

The unrest broke out days after the U.S. held what it described as an encouraging human rights dialogue with Myanmar ? the latest sign of diplomatic re-engagement with the former pariah state that has made significant democratic reforms.

The conflict in western Myanmar is rooted in a dispute over the Muslim residents' origin. Although many Rohingya have lived in Myanmar for generations, they are widely denigrated as intruders who came from neighboring Bangladesh to steal scarce land.

The U.N. estimates their population in Myanmar at 800,000. But the government does not count them as one of the country's 135 ethnic groups, and so ? like neighboring Bangladesh ? denies them citizenship. Human rights groups say racism also plays a role: Many Rohingya, who speak a Bengali dialect and resemble Muslim Bangladeshis, have darker skin and are heavily discriminated against.

The crisis has proven a major challenge to President Thein Sein's government and to opposition leader and Nobel peace laureate Aung San Suu Kyi, who has been criticized by some outsiders as failing to speak out strongly against what they see as repression of the Rohingya.

Buddhist monks have been spearheading anti-Rohingya protests, and on Thursday staged their latest one in Yangon, the country's biggest and most important city. More than 100 staged a peaceful protest at the historic Sule Pagoda.

Savile victims allege paedophile ring existed at BBC

LONDON (Reuters) - A sex scandal gripping BBC deepened on Wednesday with claims that a paedophile ring had existed involving some of its stars, as its former director general said his handling of the case shouldn't stop him becoming the boss of the New York Times.

The BBC has been thrown into disarray by accusations it helped cover up sexual abuse by one of its most celebrated former presenters, Jimmy Savile, and has struggled to explain why one of its own shows killed an investigation into it.

The broadcaster's current Director General George Entwistle has been condemned for his handling of one of the worst crises in the corporation's 90-year history and questions have also been raised about his predecessor Mark Thompson, who is set to take over at the New York Times Co next month.

The government warned the BBC on Wednesday that the scandal was raising "very real concerns" about public trust.

"These allegations do leave many institutions, perhaps particularly the BBC, with serious questions to answer," Prime Minister David Cameron told parliament.

Police and the BBC, which is funded by the public through an annual licence fee, are looking into allegations that the eccentric, cigar-chomping Savile, who died last year, abused young girls over six decades.

Some of the attacks were alleged to have taken place on BBC premises.

Lawyers representing some of the male and female victims, some of whom were as young as eight when the abuse occurred, said their clients had indicated an organised paedophile ring involving other celebrities had existed at the BBC during the height of Savile's fame in the 1970s and 80s.

"There is information of a possible paedophile ring and we have people who have approached us with that information," Alicia Alinia, one of the lead lawyers involved in the cases for the Slater and Gordon law firm told Reuters.

"It seems to be a number of people who were involved other than Jimmy Savile, I can't reveal any specific names of celebrities involved, but it seems as though it wasn't just limited to unknowns."

Earlier, the BBC said new allegations had been made against nine current BBC staff or contributors since revelations about Savile were first broadcast by rival channel ITV.

These ranged from inappropriate language or behaviour to harassment and serious claims of sexual assault.

"Where appropriate action needs to be taken and people would need to be suspended, that will happen," a BBC spokeswoman said.

In a sign the scandal could spread further, lawmaker Tom Watson told parliament a senior aide to an unnamed former prime minister might have been involved in a suspected paedophile ring.

"I want to ensure that the Metropolitan Police secure the evidence, re-examine it, and investigate clear intelligence suggesting a powerful paedophile network linked to parliament and Number 10" he said.

"REAL CONCERNS"

The developments come at a time when politicians are increasingly voicing disquiet about the BBC's broader management structure.

Culture Secretary Maria Miller wrote to the broadcaster's independent governing body to say "very real concerns are being raised about public trust and confidence in the BBC".

MPs and the media heavily criticised Entwistle for his unconvincing appearance before parliament on Tuesday to answer questions over the scandal.

Thompson, his predecessor, is also facing scrutiny over his handling of the case. The public editor of the New York Times openly questioned whether the Briton was now fit to serve in his new role with such a scandal hanging over him.

"I do not believe there is anything that I've done in relation to this matter which should in anyway impinge on my abilities to fully discharge the responsibilities I'll have at the New York Times," Thompson told Reuters.

He said he was not briefed on the high-profile investigative programme that was looking into allegations against Savile, who hosted prime-time children's shows on the BBC, and that he was not involved in the decision to kill its report.

Entwistle, who replaced him as BBC director general in September, told hostile MPs on Tuesday that failures at the corporation had allowed Savile to prey on young girls, but he too denied he had helped suppress the report.

Damian Collins, an MP from the Conservative Party and a member of the parliamentary committee which questioned Entwistle, said it still wanted answers.

"I don't think the director general gave a very convincing performance yesterday and I think there were a lot of questions about the decisions he's taken," he told Reuters.

In reference to Thompson, who was director general when the decision was taken to drop the investigative Newsnight programme into the subject, he said:

"I find it extraordinary that the decision to close down the Jimmy Savile investigation could have been taken without the knowledge of the director general, who is the editor-in-chief, because this was not any run-of-the-mill investigation.

"It was one of the highest importance, involving some very grave criminal allegations about someone who had been a BBC employee for decades."

New Study Shows HPV Shot Doesn't Encourage Sexual Activity in Girls 0 5

sexual activity in girls is not increased by hpv shot according to study iStockphoto/Thinkstock

Preteen girls who received the human papillomavirus (HPV) vaccine were no more likely than unvaccinated girls to get pregnant, develop sexually transmitted diseases (STDs), or seek birth-control counseling.

These were the findings of a new study, discounting concern that HPV vaccination encourages promiscuity, reported USA Today.

HPV is the leading cause of cervical cancer. NY Daily News said the HPV vaccine can help prevent cervical cancer, but it's most effective when given to girls before they become sexually active.

CBS News stated that the Centers for Disease Control and Prevention and the American Academy of Pediatrics recommend HPV vaccination for preteen girls and boys at age 11 or 12. Three doses are generally recommended over six months.

But less than half of girls eligible receive it, wrote MSN.com. Reuters said that one of the arguments against HPV vaccination is that it gives preteens a false sense of security when it comes to sex.

The new study seems to supports evidence to the contrary. The study involved girls enrolled in an Atlanta Kaiser Permanente health plan.

Reuters wrote that out of 1,398 girls who were 11 or 12 when they saw their doctors in 2006 and 2007, 493 got at least one dose of the HPV vaccine.

CBS News said that the researchers didn't ask girls about having sex. Instead they looked at sexual activity ?markers? after vaccination against the sexually transmitted human papillomavirus.

Specifically, they examined up to three years of records whether girls sought birth control counseling; tests for STDs or pregnancy; or became pregnant.

Very few of the preteen girls who got the shots had done any of those over the next three years, wrote Associated Press. Moreover, the study found no difference in rates of those markers compared with unvaccinated girls.

Based on primary care visit records, 107 of the girls were given a pregnancy test through 2010, and 55 were tested for chlamydia. Girls who did or didn't get the HPV vaccine were equally likely to be tested for both, said Reuters.

Going green with auto loans - Car Finance

Chances are you have heard about the global movement toward more energy-efficient initiatives.

Chances are you have heard about the global movement toward more energy-efficient initiatives. There has also been a lot of buzz about the benefits of green cars, so choosing an eco-friendly vehicle may be in store for you. If so, there are some things even in the car loan process that are different for green vehicles than regular ones.

Green car loans
One of the biggest factors driving green auto loans is the price of gasoline. Buying a car may seem like the easy part compared to keep regular expenses at the pump under control, and since hybrid and electric vehicles use significantly less gas than standard combustion engines, they take less to fill up and go farther without needing to refuel. On average, green loans apply to automobiles that get 30 mpg or better, or are considered hybrid or electric vehicles. Specific loans are available to secure these types of cars.

The great part for those with car loans on such vehicles is that it is much easier to afford monthly payments when other ownership expenses are not taking as much to fulfill. These cars also qualify for special insurance and tax breaks, making them even more cost-effective to own.

Going green with lending
The other upside to auto loans for green cars is that they tend to have lower rates than those for standard vehicles. Bankrate wrote that the terms for such notes get between 0.5 and 1 percent interest deductions, since these kinds of loans benefit both the environment and the lender. Lenders that offer green loans may gain a reputation for doing so, which can bolster their business, so they may be more willing to approve a loan for an eco-friendly car even if the borrow has less than perfect credit.

Getting a car loan for an alternative fuel vehicle provides drivers the opportunity to save money in a number of ways. Plus, the current economic environment is favorable for borrowers, making it a good time for those with bad credit to apply. Bankrate said that Millenial generation consumers, those in their 20s and early 30s, prefer these kinds of loans for their civic-mindedness as well as the fact they have mandatory fixed rates. That way, saving money and planning for regular installment payments is easier.

Volunteers make westside school a second home for kids - Earic.com

Some families were finishing their barbecue chicken, while others clustered around the stage to watch their children dance. Music pulsed. Teachers and administrators mingled with parents and students.

Dozens of volunteers, most from churches in the West Boulevard corridor, acted as hosts.

Reid Park, a public school serving students from prekindergarten to eighth grade, has faced upheaval and challenge. So have the neighborhoods it serves and many of the families who send their children.

Family night, which launched in September, symbolizes a larger quest to rebuild a fragile community, with a school at its heart. No one expects transformation to be easy. But organizers believe the best hope for academic success and community strength comes from educators, families, churches and agencies uniting to help children.

?We know with time we are going to make a difference,? said the Rev. Anthony Crowder, pastor of Storehouse Ministry. He wants to see Reid Park have a positive identity like other Charlotte areas, from NoDa to South End, and he believes the school can be the catalyst.

The model is McClintock Middle School, where Christ Lutheran Church has been drawing hundreds to family nights for six years now. Some see it as a beacon for volunteers who are seeking more sophisticated ways to engage with schools and families.

It also reflects an awareness that schools need families? help.

?We know that children go home to a family every day,? said Reid Park Principal Mary Sturge. ?It doesn?t make sense to just serve the child.?

It?s not easy

Big family events at school are second nature in more affluent areas, where parents tend to feel comfortable with school involvement, have time and money to organize activities and own cars to get to after-hours gatherings.

None of that can be taken for granted in impoverished neighborhoods. Christ Lutheran, a large church in southeast Charlotte, spends about $ 100,000 a year providing meals and transportation, says outreach director Amy Daniels.

The commitment of money and volunteers required may be why the widely admired model hasn?t spread faster. Hands On Charlotte, a nonprofit volunteer recruitment agency, is committing about $ 60,000 to launch a twice-monthly family night at Albemarle Road Elementary this year.

Hands On Charlotte chose the McClintock model because ?we?d never really found anything that got to a critical mass of impact,? despite years of sending volunteers into schools to beautify grounds and tutor children, says Associate Director Bob Young. The group selected the east Charlotte school because it has a strong principal who has already developed a network of volunteers and partners. No matter how much money and energy any outside group can bring, Young says, family connections can?t be built quickly.

?You really have to take the time to build credibility with each other,? he said. ?You just can?t get that out of a box.?

Faith in Reid Park

The Reid Park Project in west Charlotte represents years of planning among Charlotte-Mecklenburg Schools, the Mecklenburg Department of Social Services, the nonprofit Communities in Schools and the private Melange Health Solutions, a mental health group. The goal is to help students and their families achieve the health and stability needed for academic success.

Family night is just one branch of the project. As project leaders talked to families about what they wanted, they heard a yearning for connections to their school and churches.

Neighborhood churches were eager to help. They created ARK (for Acts of Random Kindness) at the Park, a coalition spearheaded by the City Dive ministry of New Birth church in Huntersville. They set about bringing in some of the opportunities families asked for, from a chance for their children to join Boy Scouts and Girl Scouts to health and fitness activities for the whole family.

Twice a month, volunteers teach art and dance classes, lead adult discussions, offer job skills and provide care for the youngest siblings. Neighborhood retirees bring in golf gear to introduce the sport to young people. The first three sessions have pulled about 300 to 500 adults and children, organizers say.

It?s still something of a shoestring operation. Reid Park Academy just got $ 25,000 from the Fred and Nancy Brumley Foundation to pay for meals. But that will only cover the first semester. Individual donors are paying for banners, T shirts and club expenses. Sturge had hoped to use Title I money for family involvement at high poverty schools to provide transportation, but that didn?t meet federal guidelines. So families rely on city buses, carpooling and faculty who can give rides.

But on Thursday night, what families saw was a host of welcoming volunteers and a good meal for everyone. As they finished eating, the Rev. Hamani Fisher of City Dive grabbed a mike, cued a DJ and called children to the stage for ?freestyling.? He called them up by age group to strut their stuff, as parents beamed and danced along.

Almost two-thirds of Reid Park?s students read below grade level, and Sturge plans to work more reading into the schedule for children and adults. But for now, she wants them to feel like their children?s school can be a second home.

Famed conductor honored by Israel's president

JERUSALEM (AP) - Israel's president has recognized Indian-born conductor Zubin Mehta for his contributions to Israeli society.

Mehta, music director for life of the Israel Philharmonic Orchestra, on Monday received Israel's Presidential Medal of Distinction. Other winners have included Henry Kissinger.

Mehta has been the philharmonic's director since 1977. He was also the longest-serving director of the New York Philharmonic.

In 2009, he started a music education program, Mifneh, which is Hebrew for "turning point," for Israel's Arab citizens.

Mehta said at Monday's ceremony that "if you can sing together, you can live together."

President Shimon Peres, a Nobel peace laureate, praised Mehta for his message of peace.

Peres said: "Israel used to be a drama, you made us into a dramatic symphony without compromising one for the other. You harmonized us."

The Trembling Uterus: Cyber Threats History: The Beginning (1960s)

In the early years of the 21st century the word "hacker" has become associated with people lurking into dark rooms and anonymously terrorizing cyberspace. But hacking and phreaking have been around since the 1960s when computers were true behemoths housed in restricted laboratories accessible only to a few geeks. Back in those days it was impossible for any teenager to buy a computer and only accredited professionals were allowed the privilege of programming these powerful machines.

The original hackers were only students, computer programmers and systems designers, adherent of a new subculture that originally emerged in the 1960s around the Massachusetts Institute of Technology (MIT)'s Tech Model Railroad Club (TMRC). The members of this model train group "hacked" their electric trains, tracks, and switches to make them perform faster and differently. A hack was simply an elegant or inspired solution to any given problem.

Later, a few of the members of the TMRC transfer their curiosity and rigging skills to the new mainframe computing systems being studied and developed on campus. At this time, MIT employed some nerds to do some artificial intelligence and computer research. These guys actually created the models for the machine you are working on right now and were truly the first programmers and engineers in the field of IT.

This new Artificial Intelligence Laboratory, with its huge mainframe computers, became the staging ground for the first computer hackers emerging at MIT. At first, "hacker" was a positive term for a person with a mastery of computers who could push programs and systems beyond what they were originally designed to do. For these early pioneers, a hack was a feat of programming prowess and such activities were greatly admired as they combined expert knowledge with a creative instinct.

These early computer hackers were programming enthusiasts, experts primarily interested in modifying programs to optimize their performance, customize them for specific applications, or just for the fun of learning how things worked. Very often, the shortcuts and modifications produced by these hackers were even more elegant than the original programs they replaced or circumvented. In fact, the most elegant?and enduring?hack from this period is the UNIX operating system, developed in the late 1960s by Dennis Ritchie and Keith Thompson of Bell Labs. ?

Lieutenant Grace Murray Hopper discovers a moth trapped between relays in a Navy computer, the Mark II Aiken Relay Calculator. She calls it a "bug," and the operators affixed the moth to the computer log, with the entry: "First actual case of bug being found". Later, Grace Hopper put out the word that they had "debugged" the machine, thus introducing the term "debugging a computer program". ?

The USSR launches Sputnik, the first artificial earth satellite. In response, the United States forms the Advanced Research Projects Agency (ARPA) within the Department of Defense (DoD) to establish US lead in science and technology applicable to the military.

In the late 1950s, AT&T began switching its telephone networks with the implementation of fully automatic switches that used specific frequency tones to communicate between them. One of these internal-use tones was a tone of 2600 Hz which caused a telephone switch to think the call was over, leaving an open carrier line which could be exploited to provide free long-distance and international calls. Around 1957, Josef Engressia, a blind seven-year-old child with perfect pitch and an emotional fixation on telephones, accidentally discovered that whistling at certain frequencies could activate phone switches. Unaware of what he had done, Engressia called the phone company and soon after he learned to whistle the 2600 Hz pitch that interrupted long-distance telephone calls and allowed him to place a free long-distance call to anywhere in the world. ?

IBM?s 7000 series mainframes were the company?s first transistorized computers. At the top of the line of computers - all of which emerged significantly faster and more dependable than vacuum tube machines - sat the 7030, also known as the "Stretch".

Programmers at AT&T's Bell Laboratories develop the UNIX operating system, the first multi-tasking operating system.

ARPA awarded the ARPANET contract to BBN Technologies. The company selected a Honeywell DDP-516 computer configured with 24 kB of expandable core memory as the base on which they would build the switch. The physical network linked four nodes: University of California at Los Angeles, SRI (in Stanford), University of California at Santa Barbara, and University of Utah. These nodes were wired together via 50 kbps circuits creating an early network used by government research groups and universities, and the forerunner of the Internet.

Edin Dzeko Was in Trusina During the Attack, Says Witness ...

The protected witness C, a former member of ?Zulfikar? Unit with the Army of Bosnia and Herzegovina, said that, after having entered the village of Trusina near Konjic he saw a few captured members of the Croatian Defence Council, HVO and three of his comrades, including Samir Semsovic, standing next to them. ?

The witness recalled that some time later Semsovic and Ahmet Kokic were wounded and that Dzeko drove them away.?? ?

?Almost all of us carried Samko and Ahmet. I think that we got a stretcher and carried them to some village. One of us asked a local resident to give us his car, which was used for transporting them somewhere else. I think that Dzeko drove the car,? the witness said.
?
The witness C said that he did not go back to Trusina afterwards but to the nearby village of Parsovici, along with some of his comrades.

After having returned to the Mount Igman, where the Zulfikar Unit Command was positioned, he found out that Semsovic died on the way.
?
When asked if he heard what happened to the captives, the witness said that he heard that they had been killed.
?
Dzeko is charged with killing Croat prisoners of war, together with other soldiers, and with killing two elderly Croat civilians, during the attack on Trusina on April 16, 1993.

The indictment also charges him with crimes against Bosnian Croats committed in Jablanica in the second half of 1993.
?
The witness C said that, prior to and during the operation he did not see neither the unit commander nor his deputy, adding that he did not hear whether anybody had issued an order that ?there must be no survivors in the village? prior to the attack.
?
The public was briefly excluded from the hearing four times, because the witness responded to questions that might have revealed his identity.
?
A new protected prosecution witness is due to be examined at a hearing scheduled for October 16.

Stocks flatline, pulled by jobless claims, Europe

Stocks fell stagnant Thursday with little significant activity up or down. Stocks rose in the morning after a positive jobless claims report but fell in the afternoon.

Company officials gather at the post for the first trades of shares of Realogy Inc. following it's IPO on the floor of the New York Stock Exchange Thursday. Stock traders appeared unperturbed by worrisome developments in the global economy.

The market closed roughly flat Thursday, underwhelmed by encouraging jobs news but unrattled by worrisome developments in the global economy.

In the morning, a government report of fewer jobless claims carried the market higher. The Dow Jones industrial average rose as much as 83 points, shrugging off a widening U.S. trade deficit, higher unemployment in Greece and a ratings cut for Spain.

By late afternoon, the rally sputtered, and the Dow wavered between small gains and losses. It closed slightly down, along with the Nasdaq composite index, while the Standard & Poor's 500 eked out the tiniest gain.

Traders, it seemed, were so used to bad news that Thursday's developments didn't really push them one way or the other.

"There's not a lot to move the market today," said Erik Davidson, deputy chief investment officer of Wells Fargo Private Bank in San Francisco. "Everyone's talking about baseball."

Joe Costigan, director of equity research at Bryn Mawr Trust Company in Pennsylvania, described Thursday as "a reasonable day."

"What we're seeing is more of a wave," he said, "not a tide."

The Dow finished down 18.58 points to 13,326.39. The S&P 500 inched up 0.28 point to 1,432.84. The Nasdaq fell 2.37 points to 3,049.41.

The Labor Department said that weekly applications for unemployment aid fell to their lowest level since February 2008, before the financial crisis, and when the unemployment rate was much lower ? 4.9 percent, compared with today's 7.8 percent.

Citi analysts upgraded U.S.?stocks?to the equivalent of buy. The analysts, led by Hasan Tevfik and Robert Buckland, argued that?stocks?are relatively cheap and that central banks seem likely to take more steps to try to boost the economy.

Still, their report wasn't all cheery, and neither were most of the other economic developments Thursday. "Profits are slowing around the world," the Citi analysts wrote, "and (earnings-per-share) expectations need to be cut further, in our view."

Already this week, the aluminum manufacturer Alcoa kicked off the third-quarter earnings season with a disappointing loss. Thursday, shares of grocery store Safeway slipped more than 3 percent, losing 58 cents to $15.71, after it reported a lower profit margin.

The Commerce Department reported that foreign demand declined for American-made cars and farm goods. In Germany, economic researchers predicted the country's growth would slow, and warned that patience for bailing out weaker European countries was evaporating. Unemployment in Greece, one of the countries surviving on bailouts, hit a record high of just more than 25 percent. And the Standard & Poor's ratings agency late Wednesday cut its rating on Spain's debt to one level above junk status.

In Tokyo, where the International Monetary Fund and the World Bank were meeting, IMF chief Christine Lagarde warned that the global economic recovery is weaker than many had expected. She called for urgent action to fix Europe's debt problems and an approaching fiscal crisis in the U.S.

A few?stocks?jumped after reports of potential new owners. Sprint Nextel soared more than 14 percent, rising 72 cents to $5.76, after a report that the company could be bought by Softbank, a Japanese cell phone provider. Truck company Oshkosh Corp. jumped more than 7 percent, up $2.05 to $28.90, after activist investor Carl Icahn offered to buy the company.

The yield on the benchmark 10-year U.S. Treasury note fell by 0.01 percentage point, to 1.67 percent.

Evernote 2.5 for Windows Phone brings new layout with improved performance

DNP Evernote 25 for Windows Phone brings new layout with improved performance

While some app developers seem to forget about Windows Phone, Evernote definitely has not. The tiled version of the cloud-based note taking app received an update on Thursday that brings an arsenal of new features, including an updated tile layout for note lists, a redesigned login / registration screen and user help tips. Perhaps the most anticipated new additions here are an improved note editing settings that adds more space to jot things down and a much welcomed performance boost. If your memory isn't quite what it used to be and you're looking for a helpful tool to take notes while on the go, you can snag the latest version of Evernote from the Windows Phone Store now. That is, if you can remember which tile to tap when trying to get there.

Cannabis extract eases muscle stiffness typical of multiple sclerosis ...

Cannabis seems to ease the painful muscle stiffness typical of multiple sclerosis (MS), indicate phase III trial results, published in the Journal of Neurology Neurosurgery and Psychiatry.

Up to 90 per cent of MS patients endure painful muscle stiffness at some point during the course of their disease, which reduces their mobility and interferes with daily routine activities and sleep quality. But current treatments often fail to resolve symptoms fully, and can be harmful, as a result of which many MS patients have experimented with alternative therapies, including cannabis.

Adult MS patients with stable disease, from 22 different specialist centres across the UK, were either randomly assigned to cannabis extract (tetrahydrocannabinol) daily (144) or a dummy pill (placebo) (135) for a period of 12 weeks.

The treatments were given in gradually increasing doses from 2.5 mg up to a maximum of 25 mg for two weeks, followed by maintenance doses for the remaining 10 weeks. The aim was to see if cannabis extract alleviated or improved muscle stiffness, associated pain, muscle spasms, and sleep quality, using a validated 11 point rating scale.

After the first two weeks of treatment, 87 per cent of those taking the placebo were on the maximum daily dose compared with just under half of those (47%) taking the cannabis extract.

After 12 weeks, one in four patients treated with cannabis extract was taking the maximum daily dose compared with over two thirds (69.4%) of those taking the placebo.

At the end of the study period, the rate of relief from muscle stiffness was twice as high among those given the cannabis extract as those given the placebo. Muscle stiffness was alleviated in just under 30 per cent of those given cannabis compared with just under 16 per cent of those treated with the placebo.

This difference was evident after 4 and 8 weeks, and also extended to pain, muscle spasms and sleep quality, at all time points, the results showed.

The differences were most noticeable among patients not already using antispasmodic treatment, among whom almost 40 per cent of those taking the cannabis extract gained relief compared with just over 16 per cent of those taking placebo.

The rate of side effects was higher among those taking the cannabis extract and highest during the first two weeks of treatment. Nervous system disorders and gut problems were the most commonly reported side effects, but none was severe.

The authors conclude that the results of their trial indicate that cannabis extract could be a useful treatment for the muscle problems typical of MS, and could provide effective pain relief, particularly for those in considerable pain.
